Don't count on CarFax, despite their ads, their fine print only lists what's reported to a state agency, etc. Dealer systems will have more info, if you can find the servicing dealer and a kind sole...

When a CARFAX report lists a car as "clean," this refers to the fact that no branded or problem titles (lemon law, salvage, junk, flood damaged, rebuilt, reconstructed, exceeds mechanical limits, or not actual miles) were found in this vehicle's past.

This also refers to the absence of an odometer rollback as indicated by the odometer readings on our report.

This does not mean that this car does not have prior damage due to accident or mechanical flaws. Please keep in mind that CARFAX does not physically inspect any of the vehicles that appear in our database. In fact, we specifically state on every CARFAX report, "Use this report as one important tool, along with a vehicle inspection and test drive, to make a better decision about your next used car." CARFAX would be incapable of disclosing a vehicle's damage unless that information was provided to CARFAX by one of our data sources.

Carfax seeks to provide as much information as possible about the history of the vehicle in order to help buyers and sellers of used vehicles make better decisions.

On the order form, right above the Process My Order button, we state:
“By processing my order, I agree to the terms of the Customer Agreement and understand that CARFAX may not have the complete history of every vehicle.”

At the top of every CARFAX report it states:
“CARFAX Vehicle History Report is based only on information supplied to CARFAX. Other information about this vehicle, including problems, may not have been reported to CARFAX. Use this report as one important tool, along with a vehicle inspection and test drive, to make a better decision about your next used car.”

In the Title section of the report we state:
“CARFAX guarantees the information in this section. The CARFAX Buyback Guarantee protects you from severe problems (major accidents, fire, flood damage, odometer problems and lemon history) that were reported to a Department of Motor Vehicles. These problems are often referred to as branded titles. No other data is covered by this guarantee program."

The Other Information section of our report mentions:
“Not all accidents or other issues are reported to CARFAX.”
In this same section we note “No accidents reported to CARFAX.” We do not state no accidents, we highlight that no accidents were reported to CARFAX.

We include this information to encourage customers to have an inspection and test drive performed and to ensure that the consumer fully understands the data we provide.

The warranty history indicates a lower coolant hose, left door weatherstrip and the recall for the washers was done.

The Court will also order Carfax to make certain changes in its disclosures and contracting process with customers.

HOW DO I OPT OUT OR OBJECT?

If you're a Class Member and want to opt out of this settlement, you must do so in writing by March 13, 2007. You must provide your full name and address, state that you want to opt out of the Carfax settlement in West v. Carfax, Inc., No. 04-CV-1898, and deliver your request by mail, hand or overnight delivery service to the Settlement Administrator so that it is received on or before March 13, 2007. If you want to object to this settlement, you must do so in writing by March 27, 2007. You must provide your full name and address, include all arguments, citations, and evidence supporting your objection, specify who, if anyone, will attend the hearing to speak for your objection, deliver your objection both to Class Counsel and to Defendants' Counsel by mail, hand or overnight delivery service so that it is received on or before March 27, 2007, and file at the same time a copy of your objection with the Clerk of Court in Warren, Ohio.
